Meridian® Commercial Limited Warranty
Tower Industries and TowerShowers.com warrants Meridian® Solid Surface Shower Bases installed in any commercial structure or used in any commercial application for a period of 1 year from the date of production. This warranty is a product warranty only. Upon a customer request, Tower Industries will repair or offer a replacement for the Meridian® shower base in question. Tower Industries will Include crating and shipping to the original product destination depot when a replacement occurs.
Tower Industries will not be responsible for any plumbing, carpentry, tear out, installation or other labor and materials costs. This is a product warranty only. Because Tower Industries is not installing this product, this warranty does not cover installation or any ancillary installation item.
Meridian® shower bases must be installed specifically following the installation guidelines included in the shower base shipment and found on the TowerShowers.com website. Tower Industries stresses the importance of installing the Meridian® shower base on a clean, even surface and setting the base in a bed of thin-set or mortar mix, assuring full even contact between the bottom of the Meridian® shower base and the floor below.
This warranty does not cover:
- Minor conditions such as stains, scratches, chips, water spots and burns with, due to the unique properties of Meridian®, may be corrected by scouring with an abrasive cleaner or by other techniques specified in care and cleaning instructions provided by and available through Tower Industries.
- Failure to comply with Tower’s installation instructions or care and maintenance instructions.
- Failure of product due to excessive heat.
- Use of product for purpose other than normal interior use.
- Any products moved from their original place of installation
Recommended water temperature is to be set at 130° or below.
Tower’s obligation under this warranty is limited to the remedies specified in the first paragraph of this warranty. No implied or express warranty of merchantability or fitness for a particular use or any other warranty except those specifically stated in this warranty or required by law is granted. Except for the remedies described in this warranty, Tower has no liability for any loss or damages arising out of the use or inability to use the Meridian® products.
This warranty gives you specific legal rights. You may also have other rights, which will vary from State to State or, in Canada, from Province to Province. Federal law does not permit the disclaimer or modification of implied warranties arising under applicable state law for consumer products. However, any of such implied warranties shall expire at the earlier of the expiration of the stated warranty or the expiration of the period for the implied warranty required under state law. Some states do not allow limitation on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusions may not apply to you.
It is understood by the buyer that any Meridian® shower bases are taken into possession by the customer at the origin shipping point at the Tower Industries manufacturing plant in Massillon, Ohio. Any and all disputes must be filed and resolved through arbitration and/or legal remedies in Stark County, Ohio.
